Bret Biedscheid will serve 90 days in jail for fleeing the scene of the crash that killed Anthony “Tony” Martin 2.5 years ago.

Biedscheid, 40, pleaded guilty to a charge of failure to perform the duties of a driver and was issued his sentence by Deschutes County District Court Judge Roger DeHoog on Tuesday.

At around 11 p.m. on January 26, 2011, Biedscheid struck Martin with his truck as Martin, 48, was pushing his bicycle across Third Street on Bend’s north side. Martin died at the scene, while Biedscheid drove off and surrendered his vehicle to Bend Police two days later.

Biedscheid had been drinking prior to the crash, however, he was not charged with driving under the influence of intoxicants. A charge of criminally negligent homicide was dropped in exchange for Biedscheid’s guilty plea.

Biedscheid must check himself in to the Deschutes County jail by noon on Wednesday. Upon his release, Biedscheid will be on probation for three years, will have his drivers’ license suspended for five years, and will be required to perform 500 hours of community service.
