A 36-year-old Bend man who police say stabbed an acquaintance in the neck and shoulder in October was sentenced on Wednesday to 5 years in prison.

David Allan Mata pleaded guilty to two counts of second-degree attempted assault on Dec. 13 in a plea agreement with the Deschutes County District Attorney’s Office.

In exchange for the plea, the district attorney’s office dropped two charges of attempted murder, three counts of second-degree assault, and one count each of first-degree burglary and use of a dangerous weapon.

Mata has been convicted of assault on four other occasions dating back to 1989, according to court documents.

Deschutes County Circuit Court Judge Stephen Tiktin sentenced Mata on Wednesday and required him to complete three years of probation after he is released from prison.

Mata used a 6-inch serrated steak knife on Oct. 2 to stab Nicholas Medrano-Garcia, 36, who later refused medical treatment.

Sgt. Cory Darling said Mata’s former wife called 911 after Medrano-Garcia called her about 2 a.m. Darling said Medrano-Garcia was struggling to take the knife away from Mata when the sergeant arrived at Medrano-Garcia’s residence on Clay Pigeon Court.

Darling and Sgt. Greg Owens then broke up the fight with little struggle.

Medrano-Garcia received a puncture wound to his shoulder blade and cuts on the left side of his neck and the inside of his upper lip.

Both subjects appeared intoxicated, and the fight lasted several minutes, Darling said.
