Real estate company sues over phone book omission

R2 Investments LLC, which does business as Coldwell Banker Mayfield Realty in Redmond, is suing Integra Telecom of Oregon Inc. for allegedly leaving the firm out of the phone book.
The suit, filed July 24 in Deschutes County Circuit Court, says Integra which is based in Portland and provides voice and data services in 11 mostly Western states was to ensure Mayfield Realty was listed in the Dex phone book for Central Oregon.
The firm is not listed in the white pages or yellow pages of either the 2008 or 2009 edition, according to Ed Fitch, the attorney for R2 Investments.
Fitch said the damages are for the omission of white page advertisements only, which the plaintiff believes has caused damages to Mayfield Realty in excess of $150,000.
The omission of yellow page advertisements is not contested in the suit, he said.
Yellow page ads are purchased by businesses from the publisher of the phone book, Shannon Riggs, of the Portland-based public relations firm Lane PR, said on behalf of Integra. The Dex phone book is published by Cary, N.C.-based R.H. Donnelley.
Richard Roberts Jr., the owner of R2 Investments, would not comment on the suit.
However, Fitch said hes been contacted by other firms with the same problem.
In a statement sent to The Bulletin, Integras vice president of corporate communications, John Nee, said: Integra Telecom prides itself on having one of the top customer satisfaction ratings in the industry and were disappointed to hear that this customer is not happy with our services.
We are currently in the process of reviewing the situation and hope that were able to resolve it directly with our customer. We will also be evaluating the situation to see if there are opportunities to enhance our processes and strengthen our customer satisfaction moving forward.
Integra is responsible for listing its clients information in the appropriate directory, according to a company form filed with the lawsuit.
Riggs said the responsibility is for white page listings only.
Fitch added that his client assumed the service agreement would include both white and yellow page advertisements.
A pretrial hearing is scheduled for Oct. 28.
