Occupy protester found guilty of failing to obey police

PORTLAND — A 22-year-old protester who was photographed taking a pepper spray blast to the face during an Occupy Portland demonstration last year has been found guilty on two counts of failing to obey police.
The Oregonian reports that Multnomah County Circuit Judge Cheryl Albrecht fined Elizabeth Nichols $260 on Thursday. Nichols’ lawyer says that’s the minimum the law allows for the non-criminal citations.
The incidents involved police orders on Nov. 17, 2011, to move out of a street and move down a sidewalk and away from a bank.
Nichols’ lawyer, Kenneth Kreuscher, says he hasn’t yet decided whether to appeal the judge’s ruling, but an excessive force lawsuit that Nichols filed against the city will go forward. Nichols and her attorney are seeking $155,000.
The lawyer says the judge’s ruling “is no excuse” for Portland police to use pepper spray against nonviolent protesters.
