Lawsuit against BMC, docs dismissed

A Bend couple’s lawsuit alleging two physicians failed to detect warning signs before the woman went into cardiac arrest has been dismissed.
Shelley and Brent Harding’s February 2016 lawsuit alleged that doctors Dana Rhode and Jeffrey Scott did not take the appropriate action in response to Shelley Harding’s reports of experiencing symptoms like chest pain and extreme exhaustion.
The couple, which sought $8.75 million, said Shelley Harding visited Bend Memorial Clinic, where both physicians worked at the time, five times during the spring and summer of 2014. She went into cardiac arrest in August 2014, which the lawsuit says caused permanent damage to her heart. The suit stated the doctors should have referred Shelley Harding to St. Charles Health System for an evaluation and observation. BMC was also listed as a defendant.
Gordon Welborn, an attorney representing the physicians, said he believes he showed in court that the Hardings’ claims were inaccurate. The couple did not explicitly raise concerns about the potential for a heart attack, he said. Had they done so, Welborn said the physicians would have acted appropriately by sending Shelley Harding to the emergency department.
According to documents filed with the Deschutes County District Court in September, the case was dismissed with prejudice, meaning the Hardings cannot file the same lawsuit again.
An attorney for the Hardings did not return a request for comment.
