Woman charged with running down, macing father could be released from jail

A 29-year-old Bend woman could be released after four months behind bars on charges she ran her dad down in a car on Easter and maced him.

Emmy Ann Gilbert has a hearing scheduled Wednesday when a judge will determine if she’s a threat to herself and the community, or if she can be released from the Deschutes County jail while she awaits trial for two felonies and four misdemeanors.

Those charges could also be downgraded as part of the Gilbert case’s ultimate resolution, District Attorney John Hummel confirmed Tuesday.

In court Tuesday, Gilbert’s attorney, Aaron Jeffers, told Deschutes County Circuit Judge Stephen Forte that he and Hummel’s office had nearly reached agreement regarding his client’s release.

The matter was put over a day while prosecutors reviewed a document Jeffers submitted.

Hummel said his office has worked extensively with Jeffers, as well as social service providers in the area, to ensure Gilbert has access to housing and mental health treatment should she be released.

Gilbert suffers from mental health issues, according to Hummel, and is listed as a Bend transient in court documents.

“Without those conditions, this is not something we would be agreeing to,” said Hummel, who added that Gilbert appeared to have “stabilized” in custody.

Gilbert has been in jail since April 1, when she was arrested at the home of her father, Paul Gilbert, on Rocking Horse Road in Bend.

According to Bend Police, the daughter had struck her father with a 2003 Volkswagen Jetta before pepper-spraying him and chasing him inside his house. After he called 911, she reportedly got on the line and spoke with the dispatcher.

Paul Gilbert received “moderate” injuries but did not go to the hospital, police stated.
