State Supreme Court denies challenge to OSU-Cascades

The legal challenge to OSU-Cascades’ new campus on Bend’s west side is over, as the Oregon Supreme Court announced Thursday it had declined to consider an appeal filed by opponents of the school.

The ruling finishes off a legal saga that began in early 2014, when Truth in Site formed over fears about the impact students would have on traffic and nearby neighborhoods. The organization hired a Portland-based land use attorney to fight the development, arguing Oregon State University-Cascades should be required to submit a long-range plan covering the 10-acre site it owns and an adjacent 46-acre property it might purchase as part of a later expansion.

OSU-Cascades now says it intends to purchase the 46-acre site, though that decision wasn’t arrived at until thoroughly vetting the property. It has argued throughout it cannot be required to plan for a property it does not yet own.

Before the case made it to the state’s highest court, an independent hearings officer, the Bend City Council, a state land use board and the Oregon Court of Appeals all ruled in the university’s favor.

An academic building on OSU-Cascades’ 10-acre campus is scheduled to open fall 2016, and a dorm and dining hall in early 2017.
