Homeless man pleads not guilty in Bend murder case

- Bend Police continued their investigation Thursday afternoon into a Wednesday evening murder at Legacy Landing, a low-income apartment complex for seniors in Bend. Joshua Lawrence Smith has been charged with second-degree murder for allegedly killing his mother, Janice Marie Smith, 59.
The man arrested in connection with the death of a homeless man found dead in a ditch in Bend in May pleaded not guilty to charges of second-degree murder and unlawful use of a weapon Monday morning.
Brian Lee Wynn, 31, was arrested on suspicion of killing David Carroll Hickman, 62, shortly after Hickman was found near his campsite behind the Pacific Pride gas station on N. U.S. Highway 97 on May 30. Hickman’s autopsy showed he died of stab wounds inflicted within 24 hours of when police discovered his body during a welfare check. Surveillance video also places Wynn with Hickman the night of his death.
A trial will be scheduled after Hickman’s toxicology report has been submitted to the court for review. During Wynn’s plea hearing Monday in Deschutes County Circuit Court, District Attorney Steve Gunnels said it was taking longer than expected to receive the report, but he anticipates it within the next two weeks.
After Wynn was arrested, police sought help from the public locating a blanket Wynn might have been wearing at the time of the incident. Sheila Miller, public information officer for the Bend Police Department, confirmed police have since located the blanket.
Little is known about Hickman and Wynn. Court records show both men were chronically homeless and have criminal records dating back more than a decade. Since 2013, Wynn has been charged more than a dozen times with theft, as well as multiple instances of disorderly conduct and criminal trespassing. Court records also show Wynn has a history of mental heath problems.
Hickman, similarly, has dozens of convictions, but appears to have resided in Jefferson County until he came to Deschutes County in 2022 or 2023. Hickman had primarily been charged with criminal trespass, though he was also convicted of reckless burning last year in Deschutes County.
Gunnels told The Bulletin the district attorney’s office has no information on motive, nor any updates beyond the information the Bend Police Department has already released.
