Man jailed for giving booze to teen who died

A 22-year-old Bend man was sentenced to 180 days in jail Wednesday for furnishing tequila to a 16-year-old girl, who died later when the truck she was driving rolled at 65 mph.

Deschutes County Circuit Court Judge Edward Perkins sentenced Lyden Smith, who pleaded guilty to furnishing liquor to a minor.

Perkins told Smith the reason the law exists is because of deaths such as Nikki Johnson’s.

Smith’s sentence was longer than most punishments handed down for furnishing liquor to a minor, said Deschutes County Deputy District Attorney Ruben Munoz.

”We were looking more at what happened as a result of Smith’s actions,” he said. ”From my experience (someone dying because an adult furnished liquor to a minor) is rare,” said Munoz.

Johnson’s family declined to comment on the sentencing, and Smith’s attorney could not be reached.

Johnson of 20876 Dione Way north of Bend was killed April 24 at about 8 p.m. when the 1989 Chevrolet pickup she was driving eastbound on Tumalo Road left the shoulder and rolled.

Earlier in the day, Johnson called Smith and asked him to pick her and a friend up at Juniper Park in Bend, according to Deschutes County Sheriff’s reports.

Smith told deputies he bought a fifth of Jose Quervo at the request of Johnson and then drove Johnson and her friend to a house off Tumalo Road.

Once at the house at about 4 p.m., Smith said he and Johnson drank three or four shots, chased with orange juice, during a half hour.

Smith said he then drove Johnson to the Tumalo Store to meet James Adams of Culver. Adams was also driving, but did not know how to get to the house off Tumalo Road, where Smith and Johnson had been drinking tequila.

Adams told deputies Johnson said she had just received her driver’s license and asked to drive his pickup back to the house on Tumalo Road. Adams agreed and climbed in the passenger seat.

Smith, driving in his own car, said he did not see who was driving as he stopped to light up a cigarette before following the truck back to the house.

After getting on the road, Johnson told Adams she had been drinking and was drunk, Adams told deputies.

Adams, who faced no charges in the case, said Johnson began intentionally weaving in the eastbound traffic lane of Tumalo Road. He told her and then yelled at her to to pull over and stop, but she kept driving and weaving, reports said.

At that point, Johnson swerved off the south side of the road, hitting gravel. She over-corrected, sending the blue and white pickup rolling. Smith, who was driving right behind the pickup, estimated they were going 65 mph.

Johnson, who was not wearing a seat belt, was ejected from the pickup during the crash.

Adams, who received head wounds in the crash, said he tried to give CPR to Johnson. Bend fire medics arrived a short time later and pronounced her dead at the scene.

Deputies discovered an almost empty bottle of Jose Quervo in the refrigerator at the house where Smith and Johnson had been drinking.
