Widgi Creek condos in potential limbo

Two proposed condo developments in Widgi Creek resort will likely be in limbo until the Oregon Land Use Board of Appeal rules on a separate but related case.
Deschutes County commissioners decided Wednesday to wait before reviewing plans for the proposed 17 condos, which would be near the first fairway and in place of the swimming pool on Seventh Mountain Drive.
A separate development for 24 homesites within the resort resulted in a dispute over whether a 1983 master plan was still valid. Opponents of the new homes appealed that decision to LUBA, which probably will issue a decision late next month. The adjacent homeowners who oppose the development say the property was originally designated as a “common area” and not available for housing development.
Kine and Kine Properties, the condo developers, will ultimately decide whether to wait for a review by county commissioners or go to the Land Use Board of Appeals. Land use law requires a final local decision within 150 days, which would be reached June 15. The developer can allow an extension of the decision period.
The commissioners expressed concern about the pending LUBA decision and asked county staff to work with the developer to see whether a delay could be worked out.
A Deschutes County hearings officer denied the proposed development in April. Kine and Kine Properties shortly thereafter appealed the decision to county commissioners.
The developer is hoping to build nine condos in an out-of-bounds area along the first fairway. The section had only recently been changed and was originally part of the golf course.
The hearings officer decided county policy doesn’t allow development of the lot because it was once part of the course.
The second proposal is for eight condos in place of the community building and pool.
The hearings officer determined the development didn’t comply with county regulations.
