Passenger in Bend fatal crash to enter guilty plea

A Bend man will plead guilty to making alcohol available at a party where an underage friend drank before crashing his car and dying.

Jason Richy Soto, 20, was a passenger in the same vehicle as Daniel Bazan on Aug. 12 when Bazan crashed into a tree near Bend High School.

Soto is charged with furnishing alcohol to a minor, a misdemeanor.

Under the plea deal he signed Friday in Deschutes County Circuit Court, Soto would serve seven days in jail followed by 18 months of monitored probation, as well as 100 hours of community service, and a pay a $100 fine.

Also as part of the deal, Soto would serve the penalties from a diverted sentence from a 2017 arrest for driving under the influence of intoxicants. Those penalties include a yearlong driver’s license suspension and a fine between $1,000 and $255,000.

Bazan, 18, was a popular three-sport athlete at Bend High School before his graduation in 2017. He was killed when he veered off NE Ninth Street between NE Emerson and NE Alden and hit a tree.

Soto, the only other person in the vehicle at the time, was critically injured.

High speed was determined to have been a contributing factor.

District Attorney John Hummel has said there is evidence Bazan had alcohol in his system at the time of the crash, but his impairment level is not known.

Soto’s attorney Andrew Doyle said his client is “content” with the proposed resolution.

“This kid has his whole life ahead of him,” Doyle said. “He is honestly one of the nicest people I’ve worked with as a lawyer.”

Despite Soto’s signature on the plea petition, the deal isn’t final until approved by a judge.

Soto’s sentencing hearing is scheduled for March 5.
